This legal notice (the “Notice”) is communicated by 2851778 Ontario Inc. (the “Corporation”), a corporation duly structured and existing under the laws of the Province of Ontario and the federal laws of Canada.
The Corporation is the exclusive owner and operator of the internet domain name mobile.xyz (the “Domain”). The Domain and its associated logo are safeguarded under intellectual property laws, and currently, as per the date of this Notice, are undergoing the process of trademark registration with the United States Patent and Trademark Office (the “USPTO”).
The Corporation hereby declares with explicit clarity and affirms to the best of its knowledge, understanding, and belief, that the Domain has never been used in conjunction or association with any other business, product, service, or project, not only in the United States and Canada but also in any other jurisdiction across the globe. This affirmation covers the entire history of the Domain, prior to its acquisition by the Corporation. This is stated to avoid any potential for misinterpretation or confusion among customers, or any potential for disparagement or discrediting of the Corporation, its officers, directors, or related persons.
Further, the Corporation reemphasizes that the Domain has not been licensed, whether expressly or implicitly, to any other business, product, service, or project for use now, nor was it ever licensed to any other business, product, service, or project for use, historically. Any unauthorized use of the Domain constitutes a violation of the Corporation’s rights and is strictly prohibited. Such unauthorized use will be remedied to the fullest extent permissible under applicable law.
The mobile.xyz Domain was first obtained on June 8, 2021 and was subsequently put in to use for the first time. All rights relating to the Domain, including but not limited to ownership, use, and control, are expressly reserved by the Corporation.
This Notice serves as a formal declaration of the Corporation’s rights in and to the Domain. No part of this Notice shall be construed as a waiver of any rights the Corporation has or may have concerning the Domain, all of which rights are expressly reserved.
